Al-Maidah (5) Ayat (verse) No.: 45
وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ وَالأَنفَ بِالأَنفِ وَالأُذُنَ بِالأُذُنِ وَالسِّنَّ بِالسِّنِّ وَالْجُرُوحَ قِصَاصٌ فَمَن تَصَدَّقَ بِهِ فَهُوَ كَفَّارَةٌ لَّهُ وَمَن لَّمْ يَحْكُم بِمَا أنزَلَ اللّهُ فَأُوْلَـئِكَ هُمُ الظَّالِمُونَ
And We prescribed for them therein : The life for the life , and the eye for the eye , and the nose for the nose , and the ear for the ear , and the tooth for the tooth , and for wounds retaliation . But whoso forgoeth it ( in the way of charity ) it shall be expiation for him . Whoso judgeth not by that which Allah hath revealed : such are wrong doers .
Aur hamne yahudion k zimme taurat me ye baat muqarrar kar di thi k jaan k badle jaan aur aankh k badle aankh aur naak k badle naak aur kaan k badle kaan aur dant k badle daant aur khaas zakhmo ka bhi badla hai phir jo shaqs isko maaf karde to wo iske liye kuffara hai aur jo loog Allah k nazil kiye huye k mutabik hukm na karen wohi loog zalim hain.
isme kaafi wazeh taur par Allah keh raha hai ki jo jispar zulm karega uske sath waisi hi saza do
lekin jo aap bata rahe hain aurata k badle aurat aur mehman k badle mehman ye galat hai aur kahin Quran me ya hadees me nahi hai aur ye sazayen bhi hakim e waqt dega koi khud se aisi saza muqarrar nahi karsakta agar apko kahin aisi hadees ya aayat mille to batayen
Allah hame deen ki sahi samajh aata farmaye Aameen
issi se judi ek aayat hai jis par loog galat matlab nikalte hain shayad ap bhi ussi aayat ko leke confuse hain insha Allah ham uski wazahat karne ki koshish karenge
Al-Baqara (2) Ayat (verse) No.: 178
يَا أَيُّهَا الَّذِينَ آمَنُواْ كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالأُنثَى بِالأُنثَى فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَاء إِلَيْهِ بِإِحْسَانٍ ذَلِكَ تَخْفِيفٌ مِّن رَّبِّكُمْ وَرَحْمَةٌ فَمَنِ اعْتَدَى بَعْدَ ذَلِكَ فَلَهُ عَذَابٌ أَلِيمٌ
O ye who believe! Retaliation is prescribed for you in the matter of the murdered ; the freeman for the freeman , and the slave for the slave , and the female for the female . And for him who is forgiven somewhat by his ( injured ) brother , prosecution according to usage and payment unto him in kindness . This is an alleviation and a mercy from your Lord . He who transgresseth after this will have a painful doom .
Aye emaan walon tum par maqtulun ka qhisaas lena farz kiya gaya hai aazad aazad ke badle ,Gulam gulam ke badle , aurath aurath ke badle, han jis kisi ku uske bhai ki taraf se kuch mafi de di jaye usse bhalayi ki itteba karni chahiye aur aasani ke sath det ada karni chahiye tumhare rab ki taraf se ye taqfif aur rahmat hai us ke bad bhi jou sar kashi karen usse dardnaakh azab hooga.
zamane jahiliyath me koi nazm aur qanoon to tha nahi , is liye zuor aur qabile kamzoor qabilon par jis tarha chate, zulm wazor ka irtekab karlete, yek zulm ki shakal ye thi kisi taqath war qabile ka koi mard qatal ho jata tu wo sirf qatil ku qatal karne ke bajaye qatil ke qabile ke kayi mardo ko , balke basa awuqath pore qabile hi ko tahes nahes karne ki koshish karte aur aurton ke bad le mard ku aur gulam ke bad le aazad ku qatal karte , Allah tala ne us farq o imtiyaz ku qatam karte hoye farmaya ke jo qatil hoga , qisas ( badle ) me usi ku qatal kiya jaye ga – qatil aazad hai tu badle me wahi aazad , gulam hai tu badle me wahi gulam aur aurath hai tu badle me wahi aurath hi qatl ki jaye gi , na ke gulam ki jaga aazad aur aurath ki jaga mard ya yek mard ke bad le me mutaaddth mard ,
us ka ye matlab nahi hai ke mard agar aurath ku qatal karde tu qisas me koi aurath qatl ki jaye gi , ya aurth mard ku qatal kard de tu kisi mard ku qatl kiye jaye ga ( jaisake zahiri alfaz se mafhom nikal ta hai ) balke ye alfaz shane nozool ke aitebar se hnai jis se wazeh ho jata hai ke qisas ma qatil hi ko qatl kiya jaye ga
Chahe mard ho ya aurath , taqath war ho ya kamzoor –
( almuslimuna tatakaaffa dima o hum ) alhadis ( sunan abi da od , kitab aljihad , bab fi alsaryah tard ali ahal al askar )
tamam musalmano ke qoon (mard ho ya aurath ) brabar hai,

goya aayath ka wahi mafhom hai jo quaan karim ki dosri aayath , ( annan anfsa binnafsi ) ( al maidah 45 ) ka hai,
ahanaf ne ise isdedlal karte hoye kaha hai ke musalman ku kafir ke qisas me qatl kiya jaye ga lekin jamhoor olama is ke qayel nahi , kyun ke hadis me wazhath hai ( la youq talu musli mun bikafir ) sahi bukhari , kitab addiyath , bab la youqtal almuslim bikafir ) musalman kafir ke badle qatl nahi kiya jaye ga (fath alqadir ) mazeed de khye aayath 45 sure al maidah
mafi ki do surate hai , ek bagair muaavzaa mali yani det liye bagair hi mahez razaye elahi ke liye maf karde na ,
dusri surat qasas ki bajaye det qabool kar lena agar ye dusri surat ikhtiar ki jaye to kaha jaa raha hai ke talib det bhalai ka etteba kare ( wa adaa un e layhi bi yehsan ) me qatil ko kaha jaraha hai ke bagayer tang kiye ache tariqe se det ki adaegi kare , aulia e maqtul ne is ki jaan bakshi kar ke is par jo ahsan kiya hai , us ka badla ahsan hi ke sath de ( hal jaza ul ehsani illal ehsan ) ( Ar rahman )
ye taqfif aur rahmath ( yani qisas , muaafi ya deth 3 surate ) Allah tala ki taraf se qaas tum par hui hai warna is se qabl ahel tawrath ke liye qisas ya mafi thi , deth nahi thi aur ahle enjil (esayion) me sirf mafi hi thi , qisas tha na deth – (ibn e katheer )
qubul det ya akahz deth ke baad qatal bhi karde tu ye sar kashi aur zyadatee hai jis ki saza use duniya o aaqirath me bhugath ni hogi.
